Where a Registered Provider constructs new student accommodation which it will let, care must be taken when certifying to ensure that the property will qualify for relevant residential use. Holiday letting of student accommodation is commonplace. In this circumstance, the relevant residential test is not fulfilled and the liability of construction becomes 17.5%. (It may be better to apply for planning permission to build new dwellings e.g. cluster flats which are not affected in this way.)
