Carbon Border Adjustment Mechanism (CBAM)

On January 17 the Department for Business and Trade published a “summary of “EU guidance” on the EU CBAM as it impacts the UK.

The Commission has issued:

1) A full list (provisional) of "National Competent Authorities" (published 9 January)

2) Active link to the CBAM Transitional Registry

3) CBAM Registry User Manual (published December 22)

4) Guidance Documents (published 22 December) for:

                1. Importers

                2. Non-EU Operators of installations

5) List of “Default Values” for the transitional period – from 1/10/23 to 31/12/25 (published 22 December):

            1. Notably, the list does not include default values for the Electricity sector.

Despite the obvious risk of distortion of trade flows (e.g. due to differential procedures and duty rates for goods arriving in NI) there still appears to be no movement from the UK on the situation with respect to Northern Ireland (there is no National Competent Authority listed for registration of importers in Northern Ireland).

The UK’s covering summary gives no additional information for UK suppliers to the EU of products subject to CAM.
